1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and SquiggleTales LLC (“SquiggleTales,” “we,” “us,” or “our”) governing your access to and use of the website at squiggletales.com and the SquiggleTales application (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Subscription Plans

SquiggleTales offers subscription-based plans that provide credits for photo enhancements and animations. Credits are allocated at the start of each billing period and do not roll over to subsequent periods.

Billing

Subscriptions are billed automatically on a recurring basis (weekly, monthly, or bimonthly, depending on your selected plan). All payments are processed securely through Stripe. Prices are displayed in US dollars (USD).

Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will send you a reminder email 7 days before each renewal.

Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, you will retain access to the Service and any unused credits until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.

Money-Back Guarantee

We offer a 30-day money-back guarantee on all subscription plans. If you are not satisfied with the Service within the first 30 days of your initial subscription, contact us at hello@squiggletales.com for a full refund.

5. Acceptable Use

You agree not to use the Service to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Upload content that infringes on the intellectual property rights of others
  • Upload photos of individuals without their consent (or the consent of their legal guardian)
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any commercial purpose not expressly authorized by us
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service
  • Circumvent or attempt to circumvent usage limits or credit restrictions

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice.

6. Intellectual Property

Your Content

You retain all ownership rights to photos you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process, store, and display your content solely to provide the Service to you. We do not claim ownership of your content.

Generated Content

Enhanced photos and animations generated by the Service based on your uploads are owned by you. You may use, download, share, and distribute your generated content for personal and non-commercial purposes.

Our Property

The Service, including its design, features, code, logos, and branding, is the property of SquiggleTales LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

7. AI Processing

The Service uses artificial intelligence to enhance photos and generate animations. While we strive for high-quality results, AI-generated content may not always meet your expectations. We do not guarantee specific outcomes for any individual photo.

Your photos are processed by our AI systems solely for the purpose of fulfilling your requests. Your photos are never used to train AI models.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORY FLICK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your content
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless SquiggleTales LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in New York, New York.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
